These Terms of Service (“Terms”) govern your access to and use of NewAge English, including the website newageenglish.com, web application, lessons, RealLife™ simulations, assessments, certificates, and related features (the “Service”), operated by NEWAGE ENGLISH LLC (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
You must be legally able to enter a binding contract in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree to these Terms, do not use the Service.
You may need an account to access certain features. You agree to provide accurate information, keep credentials secure, and notify us promptly of unauthorized access. We may suspend or terminate accounts that violate these Terms, pose security risks, or remain inactive for extended periods, subject to applicable law.
The Service is provided for personal, non-commercial educational use unless we agree otherwise in writing. You agree not to:
Paid plans, if offered, are described at checkout. Fees are charged through third-party payment processors. Unless stated otherwise, subscriptions renew automatically until cancelled. Refunds are handled according to the policy displayed at purchase and applicable consumer law. We may change pricing with reasonable notice for future billing periods.
All content, software, design, trademarks, logos, lesson materials, audio, video, certificates, and documentation in the Service are owned by NEWAGE ENGLISH LLC or its licensors and protected by copyright, trademark, and other intellectual property laws. NewAge English was founded by Mayke Severiche. No license is granted except as needed to use the Service as intended.
You may submit text, audio, or other materials through exercises, writing tasks, or support channels (“User Content”). You retain ownership of your User Content, but grant us a worldwide, non-exclusive license to use, store, display, and process it solely to operate, improve, and secure the Service (including AI-assisted feedback where enabled). You represent that you have the rights to submit User Content and that it does not violate law or third-party rights.
The Service provides language learning tools and CEFR-oriented guidance. We do not guarantee specific exam results, job outcomes, or fluency within a fixed time. Certificates and level estimates reflect platform progress and are not a substitute for official government or institutional certification unless explicitly stated.
The Service may link to or integrate third-party sites (e.g., authentication providers, video platforms, payment gateways). We are not responsible for third-party terms or practices. Your use of those services is at your own risk and subject to their policies.
Our collection and use of personal information is described in the Privacy Policy, including cookies, authentication, and data handling practices. By using the Service, you acknowledge that policy.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEWAGE ENGLISH LLC AND ITS FOUNDERS, OFFICERS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold harmless NEWAGE ENGLISH LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights through your User Content.
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to protect the Service and users. Provisions that by nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive termination.
We may modify these Terms by posting an updated version on this page. Material changes may be notified via email or in-app message. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.
These Terms are governed by the laws of the State of Louisiana and applicable federal law of the United States, without regard to conflict-of-law rules. Disputes shall be resolved in courts located in Louisiana, unless mandatory consumer protection laws in your country require otherwise.
